The Allahabad High Court today stayed the arrest of Bollywood actor Salman Khan in the case of manhandling of people by his bodygaurd in Kanpur on August 14.
A division bench comprising Justices Yatindra Singh and Dharni Dhar Jha stayed his arrest on the actor's petition. The Court has asked the state government and others to file their reply in four weeks.
ALLAHABAD: The Allahabad high court on Friday stayed the arrest of actor Salman Khan in connection with an FIR lodged against him in Kanpur district.
In the FIR lodged at Kakadeo police station in Kanpur on November 28, 2011, by one OP Singh, it was alleged that he had tried to hand over an 'Anna cap' to Salman during his visit to Kanpur on August 24. He also alleged that instead of taking the cap, Salman instigated his bodyguards to use force to stop him. The guards not only manhandled him but also caused injuries.
Passing this order, a division bench consisting of Justice Yatindra Singh and Justice Dharni Dhar Jha directed the state government to file reply to the writ petition. It was argued on the behalf of the petitioner that FIR had been lodged with mala fide intentions only in order to gain publicity.
Talking to TOI, Salman's lawyer said: "Since the police did not lodge FIR, the complainant lodged a private complaint under 156 (3) before chief judicial magistrate, Kanpur. The magistrate directed the police to register FIR against Salman's bodyguard Shera and the unknown bodyguard. The magistrate also directed that if during investigation, the police finds anything against Salman Khan, they should lodge FIR against him also. However, the police misinterpreted the order, exceeded its jurisdiction and lodged FIR against Salman Khan without investigating the matter."
Salman had filed writ petition under 226 of the Constitution for quashing of the FIR against him
